Kathmandu, Nov 21: Lawyers, lawmakers
and legal experts have stressed that discussions should now be focused on the
issue of formation of local courts along with full authority for the guarantee
of easy access of people to justice.
At a programme organised by the Nepal
Law Society, they said political parties and court itself could not pay their
attention for necessary discussion till date on the issues of formation of
local courts, their jurisdiction, number and structure.
They expressed the view that the issue
of local courts is under the shadow as attention of all has been focused on the
issue whether or not to have the constitutional court.
The speakers argued that it would be a
wise decision to keep the existing district structure in any way in order to
provide effective services to people. They also drew the attention of bodies
concerned to be aware that the issue of establishment of around 1,000 local
courts after the country adopted federalism would be challenging.
Stating that it was necessary to know
that there would be no improvement in the situation until the attitude of the
people is changed, they said an agreement has been reached among political
parties to form a mechanism under the leadership of former chief justice to
address issues of the court.
Establishment of local courts is
believed to take the judiciary system and judiciary rights at local level like
other bodies of the state and to recognize customary laws to settle dispute.
On the occasion, Chairman of Judges'
Society, Kalyan Shah, lawmakers Ramesh Lekhak, Agni Kharel, Laxmanlal Karna,
Khimlal Devkota, Chairman of NLS, Komal Prakash Ghimire, General Secretary
Pushpa Bhusal, Mission Chief of International Idea, Nepal, Sherry M Thapar,
among others suggested to hold discussions about the necessity and importance
of local courts. RSS
