9: The Supreme Court has ordered against issuing an interim order in the power
development agreement reached in connection with the Upper Karnali Hydropower
Project.
A single bench
of Justice Girish Chandra Lal today concluded that the since the PDA was
intended to relieve the country from power scarcity and directly concerned with
the development of the country it did not warrant an interim order as demanded
by the petitioner.
The decision
came in response to a writ petition filed by Damber Rawal on behalf of the
locals of the project site, arguing that the agreement was against interim
constitution, existing act and regulations. The writ was filed on September 24.
